“Culinary Adventure” Sweepstakes

OFFICIAL RULES

 

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

1.  HOW TO PLAY / DEADLINES:  Sweepstakes begins January 29, 2008 at 12:00:01 A.M. Pacific Time (“PT”) and ends January 31, 2009 at 11:59:59 P.M. PT (the “Promotion Period”). A series of prizes will be offered in this promotion, and may change in content and value as often as monthly during the Promotion Period. Participants are encouraged, therefore, to revisit the website and enter to win in each separate prize drawing. One drawing shall be held each month (each “Drawing”). To enter, simply visit www.landofwineandfood.com, complete the Sweepstakes entry form provided in entirety, and submit. The entry deadline for each drawing will be clearly stated on the website, and all entries must be received by the time and time specified, in order to be eligible for that particular Drawing (the “Drawing Period”).  No submissions for any Drawing will be accepted after the end of the applicable Drawing Period. Limit one entry per person and per valid and unique e-mail address per Drawing Period. If more than one entry is received from the same person or from the same e-mail address during the Drawing Period, all entries from said person or e-mail address will be disqualified. Entries become the property of California Travel & Tourism Commission (the “Sponsor”) and will not be acknowledged or returned. Sponsor reserves the right to void all entries made through any robotic, automatic, mechanical, programmed or similar entry duplication method and to disqualify any individual using such a method. In the event of dispute, entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry, provided such person meets all eligibility requirements set forth in these Official Rules. The “authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted e-mail address.  Any entries not in conformance with these Official Rules will be disqualified.

No responsibility is assumed by the California Travel & Tourism Commission, or its respective subsidiaries, parents, partners, or other contest sponsors for lost, late, misdirected, or illegible entries. All entries become the property of the California Travel & Tourism Commission and will not be returned. The potential winner may be requested to provide the California Travel & Tourism Commission with copy of his/her Social Security Card and driver’s license/government issued identification. Contestants unable or unwilling to provide this information will be disqualified.

2.  PRIZES/VALUES: Up to twelve (12) prize travel packages will be awarded during the Promotion Period (up to one prize for each Drawing and each Drawing Period).  Each prize will consist of a trip for 2 to a pre-selected region in California, featuring wine and food-related destinations and activities. When applicable, each trip includes round-trip coach airfare from major airport that Southwest Airlines flies nearest winner’s home, hotel accommodations (double occupancy) for duration of specified package, transportation to/from specified trip events/tours, and some meals/entertainment.  The Approximate Retail Value (ARV) of each prize package will vary per Drawing, but will not exceed $4,999. Specific prize package details for each Drawing will be determined by Sponsor, and will be posted at Sponsor’s website at the start of each Drawing Period. Specific prize package details will be determined by Sponsor, and will be posted at Sponsor’s website.  Winner and winner’s designated travel companion(s) must travel on same itinerary.  Hotel accommodations and air transportation are subject to availability, blackout periods and other possible restrictions. Trip must be redeemed within one year of award notification date.   All other costs, taxes, fees, and expenses associated with any element of any prize not specifically addressed above, including gratuities, in-room hotel purchases and telephone charges are the sole responsibility of the winner. All federal, state and local taxes on prizes, if applicable, are the winner’s responsibility. Each winner will be issued an IRS 1099 Misc. Income tax form for the ARV of their respective prize. Prizes are non-transferable, nor will prize substitutions or cash redemptions be permitted, except at the sole discretion of the Sponsor.  Sponsor also reserves the right to substitute a prize (or portion of prize) of equal or greater value. Limit one prize per household per Promotion Period.

3.  ELIGIBILITY: Sweepstakes is open to legal residents of the 50 United States and D.C. who are 21 years of age or older at time of entry. Employees of the Sponsor, their respective affiliated companies/agencies, advertising and promotion vendors, prize providers, and members of the immediate families or households of any of these entities are not eligible to enter. Federal, state, and local laws and regulations apply. Winners during the Promotion period are not eligible to win another Drawing during the Promotion Period.

4. DRAWING/ODDS: There will be up to twelve (12) random Drawings held in conjunction with this Sweepstakes. Each Drawing will take place on or about the tenth day after the announced end of each Drawig Period for each Drawing offered during the Promotion Period. Each drawing will be conducted by an independent judging organization, and entrants need not be present to win. Judges’ decisions are final in all matters relating to this Sweepstakes.  Odds of winning in any Drawing Period depends upon the total number of eligible entries received by the announced end of each Drawing Period.

5.  PRIZE NOTIFICATION/WINNER VERIFICATION: Winners will be notified by phone and/or e-mail and confirmed in writing. Each winner will be required to execute and return an Affidavit of Eligibility/Liability Release and, except where prohibited by law, a Publicity Release within ten (10) days of date on prize notification, or prize will be forfeited and an alternate winner will be selected.  Guest(s) of each winner will be required to sign/return a Travel Companion Liability Release within the same time period. (If travel companion is a minor, written parental/guardianship permission will be required).  If Sponsor is unable to contact a potential prizewinner, if the potential winner fails to complete and return all forms by the specified date or if potential winner fails to comply with any of the requirements, or if any prize or prize notification is returned as undeliverable, an alternate winner shall be selected. WINNERS CONSENT TO THE USE OF THEIR NAME, PHOTOGRAPH, LIKENESS, BIOGRAPHY, VOICE AND/OR VIDEO FOR ADVERTISING AND PROMOTIONAL PURPOSES, INCLUDING ONLINE ANNOUNCEMENTS, WITHOUT ADDITIONAL COMPENSATION, EXCEPT WHERE PROHIBITED BY LAW.  All prizes will be awarded.

6. RELEASE: By entering, entrants acknowledge compliance with these Official Rules, including all eligibility requirements and agree to release Sponsor and their respective affiliates and agents, successors or assigns (collectively the “Releasees”), from any claims, losses, actions, or damages, whether actual, incidental or consequential, arising out of or relating to entrants’ participation/entry process in this Sweepstakes, or the acceptance, possession or use/misuse of any prize, or participation in prize-related travel activities. Releasees are not responsible for: (i) electronic transmissions/entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected, or not received by the Sponsor or its agents for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries,  (iii) failed or unavailable hardware, network, software or telephone, cable or satellite transmissions, damage to entrants’ or any person’s computer and/or its contents, or causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes or (iv) any entries submitted in a manner that is not expressly allowed under these rules. All incomplete or non-conforming entries will be disqualified.  Sponsor is further not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the transmission, receipt or processing of the entries.  If for any reason this Sweepstakes is not capable of running as planned, or if this Sweepstakes or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Sweepstakes and processing of entries per these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in Sponsor’s sole opinion, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend this Sweepstakes.  In the event this Sweepstakes is cancelled, Sponsor reserves the right to conduct a random drawing to award the prizes from among all eligible, non-suspect, entries received prior to the time of the action or event warranting such cancellation.

7. CONDUCT: By entering any Drawing, you agree to be bound by these Official Rules. You may also obtain a copy of these Official Rules by sending a self addressed stamped envelope to Wine & Food, CA Travel & Tourism Commission, PO Box 1499, Sacramento, CA 05812. Contestants further agree to be bound by the decisions of the California Travel & Tourism Commission, which shall be final and binding in all respects. The California Travel & Tourism Commission reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or to be acting in violation of the Official Rules.

8.  CAUTION.  ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS.  SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY ANY SUCH PERSON AND SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

9.  WINNER’S LIST:  For the names of the winners, send a self-addressed, stamped envelope to: California Travel & Tourism Commission “Culinary Adventure” Winner Request, P.O. Box 25497, Rochester, NY 14625,  to be received no later than 3/15/09.
